How Annex XIII is structured
Annex XIII numbers its content in four points. Point 1 is publicly accessible model information. Point 2 is model information open only to persons with a legitimate interest and the Commission. Point 3 is open only to notified bodies, market surveillance authorities and the Commission. Point 4 is data about an individual battery, open only to persons with a legitimate interest. Article 77(9) confirms the split when it refers to persons with a legitimate interest "as referred to in points 2 and 4 respectively of Annex XIII".
The legitimate-interest tier is not settled law yet
Article 77(9) requires the Commission to adopt an implementing act specifying who counts as a person with a legitimate interest, and exactly which Annex XIII data they may access, download, share, publish and re-use. That act was due by 18 August 2026 and has not been adopted — as of July 2026 it remains at planning stage, with no draft published for feedback. Treat every legitimate-interest assignment below as our reading of the Annex text, not as a settled legal allocation. The tier boundaries can still move.
